In fact, unless there's a disclaimer stating that one agrees to allow their personal mp3/lessons to be used free of charge, then you're not allowed to use one's work without express written or implied permission (it's called intellectual property). And even if that disclaimer is made from here on in, it has no retroactive effect, meaning he should either dump the entirety of the lessons/mp3s hosted since that time or individually ask for permission from each contributor.
